Terms and Conditions
1. LEGAL STATUS AND FRAMEWORKSole Trader Operations
All photography services, image sales, and contractual agreements are provided by Knighton Photography operating as an independent sole trader.Child Safety Compliance
The photographer holds a valid Victorian Working with Children Check (WWCC) and strictly adheres to the Victorian Child Safe Standards. No photography will take place in change rooms, bathrooms, or player medical areas.2. CONTRACTED CLUB SERVICES (Team & Individual Portraits)This section applies to formal portrait days conducted under direct contract with a sporting club.Club Responsibility
The contracted club is solely responsible for obtaining parental or guardian media consent for all participating minors during season registration.Opt-Out Protocol
The club must provide the photographer with a list of any players lacking media consent prior to the session. These individuals will be excluded from group and individual portrait products.Deliverables
Portrait packages and team prints will be fulfilled and delivered via a secure, password-protected online portal or coordinated club distribution within 3 weeks of the photo session.3. INDEPENDENT GAME-DAY COVERAGE (Live Action Shots)This section applies to live, unscripted match action captured independently for display and sale on www.knightonphotography.comPublic Domain Capture
Action shots are captured in open, public, or club-sanctioned viewing areas during active gameplay.Right to Request Removal
We respect parental privacy. If a parent or guardian wishes to have an action photo of their child removed from our public website gallery, they may submit a formal request via email to [email protected] with a link to the image. The photo will be permanently deleted within 48 hours.No PII
Action images published online will never be tagged or captioned with personally identifiable information (PII), such as a minor’s full name, age, or contact details.4. LIMITATION OF LIABILITYLiability Cap
Professional liability is strictly limited. In the event of data loss, equipment failure, or sudden illness preventing completion of a contracted session, the photographer’s financial liability is strictly capped at the total monetary amount paid by the hiring club or client.Game-Day Interruption
The photographer is not liable for missed action shots due to weather, match cancellations, scheduling shifts, or field obstructions beyond their reasonable control.5. GOVERNING LAWThese terms are governed by the laws of Victoria, Australia. Any legal disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
Digital Image License Agreement
This Digital Image License Agreement is between Knighton Photography ("Seller") and the Customer ("Licensee") for the digital image(s) purchased through knightonphotography.com1. GRANT OF LICENSEThe Seller, as the sole owner and creator of the images, grants the Licensee a non-exclusive, non-transferable license to use the purchased digital image(s) strictly in accordance with the terms of this agreement.2. PERMITTED PERSONAL USEThis license is for personal, non-commercial use only. Permitted uses include:Displaying the image on personal electronic devices (e.g., as wallpaper).Sharing on personal, non-commercial social media accounts.Printing a physical copy of the image for private, domestic display.3. PROHIBITED USESThe Licensee shall not use the image in any way not expressly authorised by this agreement. Prohibited uses include, but are not limited to:Commercial Use
Any use intended for broadcast, public exhibition, marketing, or advertising.Resale or Distribution
Reproduction for resale or distribution where the main value lies in the image itself (e.g., posters, mugs, or "print on demand" services).False Representation
Representing, expressly or implied, that the Licensee is the original creator of the image.Modification
Cropping, altering, or combining the image with other material in a way that infringes third-party rights or is defamatory.4. COPYRIGHT AND INTELLECTUAL PROPERTYThe Seller retains full copyright of the image(s). Copyright lasts for the lifetime of the photographer plus 70 years. Unauthorised use may result in termination of this license and may lead to civil or criminal penalties under Australian law.5. LIABILITY AND INDEMNITYThe Licensee agrees to defend, indemnify, and hold the Seller harmless from all damages, liabilities, and expenses arising out of the Licensee's use of the image outside the scope of this agreement.6. GOVERNING LAWThis agreement is governed by the laws of Victoria, Australia. Any disputes arising under this agreement shall be submitted to the exclusive jurisdiction of the courts of Victoria.
